Contract Agreement

If you will be paying for services provided by an individual or corporation—but have determined from the above table that the vendor will not be an employee—you must work with ISBER to set up an official University contract through either Purchasing or Business Services. You are not authorized to sign any contract/agreement, or make any sort of payment negotiations on behalf of the University or your project. Any contract or agreement MUST be certified by UCSB’s Business Services Office to be valid. Without such an agreement/contract in place ahead of time, payment may be impossible.

 

Contact ISBER if you need to set up a contract, and remember WORK CANNOT COMMENCE UNTIL THE CONTRACT IS FULLY EXECUTED. The following table will help you determine what type of agreement is most appropriate for your project:

Type of Service

Agreement Needed

Services obtainable through conventional commercial channels-e.g. copier repair & maintenance, equipment maintenance.

Purchase Requisition

Technical writing, editing, translation services, appraisals, architects, engineers, performing artists, doctors, nurses.

Personal or Professional Services

A recognized authority in a specific industry or enterprise providing a written or verbal opinion report, recommendation or action plan to the University on a specific topic or issue.

Independent Contractor

Can the University control the result of service?

Is the work primarily advisory in nature, providing a recommended course of action for a clearly delineated problem, having an end product which is basically a transmittal of information (either written or verbal)?

For both Personal/Professional Services Agreements and Independent Consultant agreements a Request for Services form must be completed, and submitted to ISBER at least TWO WEEKS before services are required. Contracts take at least 10 business days to process.

 

Payment for Service is not the only reason a contract is needed. Contracts are also needed for all of the following:
